Three diverse contexts will be in a particular focus: Colombia, whose innovative Special Jurisdiction for Peace has rendered its first important rulings; Sudan, whose domestic justice pursuits are currently impeded by a new wave of hostilities, and whose survivors received some redress in the ICC’s new judgment; and Ukraine, whose proactivity in investigating conflict-related crimes faces the challenges of ongoing warfare, limited access to occupied territories, and an overwhelming and increasing number of crimes.
Questions for discussion:
- How has Colombia balanced the ongoing implementation of its peace agreement, ICC engagement and the development of its transitional justice vision?
- What potential does the ICC’s new Sudan ruling have for survivors, whose immediate reality does not seem to promise the cessation of hostilities or the delivery of other forms of justice in the near future?
- How does Ukraine develop its prosecutorial priorities, and how do they interact with international and universal jurisdiction proceedings?
- What aspects of the JEP and Colombia’s wider transitional justice framework have been principal in discontinuing the ICC’s preliminary examination into the country?
- How are international criminal justice and universal jurisdiction proceedings perceived in Ukraine, and how do they impact the nation’s transitional justice priorities?
